We were surprised and disappointed that the SEC decided to file a lawsuit in these circumstances, and we do not agree with the legal position of the SEC. Together with our consultants, we continue to evaluate the best ways to resolve the situation in the interests of the parties involved, including, but not limited to, evaluating whether it is worth trying to postpone the launch date. We are working hard to quickly resolve these issues, and hope to provide further updates over the next week. Respectfully,

U.S. court bans cryptocurrency sale by Pavel Durov
A New York court ruled to ban the sale of Gram cryptocurrency. Pavel Durov still has a chance to appeal the decision in a dispute with the US Securities Commission (SEC), but there is little chance of success.
Judge Kevin Castel agreed with all claims made by the SEC and recognized Gram as a security. Gram tokens were not intended for storage by investors, but for further resale. This action carries certain risks in the future, so the Telegram team had to register the placement of securities under US laws.
The decision of the New York court is not the end of the dispute process, but it significantly reduces the chances of Pavel Durov winning. This means that he will have to return all the money to investors. Previously, the founder of the project promised to return 77% of the invested amount, this is more than $ 1.3 billion.
The Telegram litigation with the SEC has been ongoing since the end of 2019. At the beginning of the year, lawyers of the Securities and Exchange Commission conducted an interrogation of Pavel Durov in order to find out the sources of financing. It also became known that one of the Gram investors is Roman Abramovich, Mikhail Abyzov, Mikhail Gutseriev and the widow of Steve Jobs.
